These Terms of Service ("Terms") govern your access to and use of Hogmatix ("the Service"), operated by Forge Analytics & Systems Inc. ("we", "us", or "our"), a company incorporated in Ontario, Canada. By creating an account or using the Service, you agree to be bound by these Terms.
You must be at least 13 years of age to use Hogmatix. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
Hogmatix is a social media scheduling and automation platform that allows users to connect their social media accounts (including X/Twitter and TikTok) and schedule or publish content to those platforms through official platform APIs.
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at payme@ishti.org if you suspect unauthorized access.
When you connect a third-party account (such as TikTok or X/Twitter) to Hogmatix, you authorize us to access and use that account solely to provide the Service. Your use of connected platforms is also subject to those platforms' own terms of service. You are solely responsible for ensuring your use of Hogmatix complies with each platform's policies, including:
We are not responsible for actions taken by third-party platforms, including account suspensions or content removals resulting from your use of the Service.
You agree not to use Hogmatix to:
You retain ownership of all content you create and publish through Hogmatix. You are solely responsible for the content you post and must ensure it does not violate any laws or third-party rights, including intellectual property, defamation, and privacy laws. We do not review content before it is published and are not liable for any content posted through your account.
Hogmatix uses the TikTok API to publish content on your behalf. Your use of TikTok features within Hogmatix is subject to TikTok's Platform Policy and Terms of Service. We will only request the minimum permissions necessary to deliver the Service.
You may revoke Hogmatix's access to your TikTok account at any time through TikTok's app permission settings. Revoking access will prevent Hogmatix from publishing to TikTok on your behalf but will not automatically delete your Hogmatix account.
Hogmatix may offer paid subscription tiers. Fees, billing frequency, and payment terms will be disclosed at the point of purchase. All fees are in USD unless otherwise stated. We reserve the right to change pricing with 30 days' notice. Refunds are provided at our discretion on a case-by-case basis.
You may delete your account at any time by contacting payme@ishti.org. We reserve the right to suspend or terminate your account immediately if you violate these Terms, without liability to you. Upon termination, your right to use the Service ceases and we will handle your data as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE PUBLISHED WITHOUT DELAY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORGE ANALYTICS & SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Forge Analytics & Systems Inc. and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
